Villegas Carrera, Inc. represents clients in employment matters, including wage and hour class actions and discrimination claims. Villegas Carrera has successfully represented thousands of workers and has recovered millions of dollars in unpaid wages, penalties, emotional distress damages, lost wages and benefits for its clients. Our main objective has been to make an impact in the lives of California’s workers. Our goal is to provide our clients with effective, results oriented legal representation.
We zealously represent our clients. While no firm can guarantee success, we endeavor to meet our litigation goals and client objectives. Protecting your interest is our objective, and once retained, our responsibility.
While Villegas Carrera does not represent employers in employment litigation matters, the firm has expanded its focus to advice and counsel employers and companies to prevent employment litigation. Employers have come to recognize the benefit of working with an aggressive Plaintiffs’ side litigation firm for preventative representation. (Click here for information on our services for Employers).
Villegas Carrera collaborates with non-profit civil rights legal organizations throughout the State of California by providing resources, litigation support, legal clinic support and co-counseling. It has been our pleasure to co-counsel and otherwise work with important civil rights organizations such as the The Lawyers Committee for Civil Rights, The Mexican American Legal Defense and Educational Fund, United Farm Workers of America, AFL/CIO, California Rural Legal Assistance Foundation, The Legal Aid Foundation of Los Angeles, California Rural Legal Assistance, Inc., Legal Aid of Marin, Canal Community Alliance and the Watsonville Community Law Center. Together, we provide effective legal representation for low wage workers. Proudly we have received both litigation support and funding to aid us with impact litigation from the Impact Fund of Berkeley, California, and the Consulate of Mexico.
Class Actions allow one person or a few individuals to represent the entire workforce. These individuals can enforce the rights of hundreds or sometimes thousands of workers. Because class actions are a powerful tool in enforcing workers’ rights, they yield the best results for an entire group of workers. Since we opened our doors in 1999, we have been extremely successful at obtaining results for large groups of workers. Learn More >
Wage and Hour Violations
In California, the legislature has established a minimum wage and guidelines which regulate how an employee will be paid for their time spent on the job. We have represented thousands of clients with their claims for unpaid regular and overtime wages, commissions, split shift premiums, reporting time pay, and meal and rest premiums. Learn More >
If you were recently fired from your job, you may be entitled to monetary damages for lost wages and emotional distress as a result of wrongful termination. If your employer’s behavior was egregious enough at a high level, you may also be entitled to punitive damages.
We have successfully represented hundreds of wrongful termination clients throughout California. We have obtained millions of dollars on behalf of our clients, winning favorable results in unlawful termination cases against some of California’s largest employers. Learn More >
Employment Discrimination and Harassment
Villegas Carrera is dedicated to ensuring equal rights for all. Additionally, both federal law and the California Fair Employment and Housing Act prohibit sexual harassment. In California if a manager engages in sexual harassment against an employee under their direct supervision, the company may be held strictly liable. Furthermore, employers cannot retaliate against you because you complain about sexual harassment. We represent employees who have experienced discrimination and harassment based on:
- Sexual orientation
- Medical Condition
- Sex (which includes pregnancy, childbirth, breastfeeding and medical conditions related to pregnancy, childbirth or breastfeeding)
- Gender, Gender indentity, and Gender Expression
- National origin
- Age (40 and over)
Both state and federal law make it illegal for employers to discriminate in various aspects of employment, including hiring, promotion, job assignment, wrongful termination, compensation, and different forms of harassment.
Federal and state statutes comprise the body of these employment discrimination laws, although the U.S. Constitution and various state constitutions also provide measures of protection against bias in employment. If you feel that you have been the victim of discrimination, you should know your legal rights and speak with an employment discrimination lawyer. Learn More >
